Tenterden and Rural Sites DPD

 

The Tenterden & Rural Sites Development Plan Document (DPD) forms part of the Ashford’s Local Development Framework and will deal primarily with the allocation of residential development in Tenterden and other rural settlements. The DPD also covers a range of policies that deal with rural planning issues. It is consistent with the strategic planning approach for the rural areas, as set out under Policy CS6 of the Adopted Core Strategy.

Examination in Public

The Submission Version of the Tenterden and Rural Sites DPD was submitted to Government on the 22nd February 2010.  The Secretary of State appointed Inspector Stephanie Chivers BA DipTP MRTPI, to conduct the Examination in Public. The Inspector will check for legal compliance and establish soundness under the three tests i.e. if the DPD is justified, effective and consistent with national policy.

 

The Council also proposed a series of further amendments to the DPD , in response to the representations received on the ‘Schedule of Proposed Changes’ November 2009. The proposed amendments are changes that the Council have invited the Inspector,to recommend in her subsequent binding Report. These further amendments were submitted alongside the DPD .

 

 

Post Examination Procedures

The Examination hearings commenced on Tuesday 22nd June 2010 and ended on Thursday 1st July, however the Examination remains 'open' until the Inspector's report is received.

 

The Inspector intended to submit her report to the Council for 'fact check' by 20th August 2010, however this has been delayed and is expected to be received within the next 2 weeks. Once received, the Council will have 2 weeks to carry out the fact check of the report, and then the Inspector a further week to make any necessary changes before the final report is dispatched. Therefore the anticipated date for receiving the final Binding Inspector's report is 24th September 2010.

 

If the Inspector finds the DPD 'sound' the Council will seek to adopt the DPD as soon as reasonably practicable. At the same time as adoption of the DPD the Council is required to publish on this website, the Inspector's binding report.

 

Further proposed amendments to the Tenterden & Rural Sites DPD

Following comments made by participants at the formal hearing sessions of the Examination, at the invitation of the Inspector, the Council are proposing a series of further minor amendments to the Tenterden and Rural Sites DPD. These are set out in the table below and are published for information purposes only.

 

The consultation period has now ended and written representations are available to view within the Examination Library document 51.

 

Post Hearing Consultation into the Abolition of Regional Spatial Strategy (RSS) and amended Planning Policy Statement 3 (PPS3)

Following recent government announcements in relation to Regional Spatial Strategy (RSS) and national planning policy PPS3 (Housing), the Inspector invites the LPA and those representors who have made formal representations both at the Publication Version and Proposed Changes stages of Tenterden and Rural Sites Development Plan Document, to make written representations on the possible implications of these changes for the soundness of the submitted DPD Post Hearing Consultation.doc

 

In order to prevent or minimise any delay in the submission of the Inspectors fact check report, please would you submit any written representations by Friday 30th July 2010 to the Programme Officer.

 

The consultation period has now ended and written representations are available to view within the Examination Library document 50.

Pre-Examination Meeting
