The Role of Legal Services in s.106

On these pages we use the term s.106 as a shorthand. This covers all of the following terms you may have heard:

Legal Services advise and act for the Council and so are unable to advise outside parties. Please instruct your own solicitor at the outset of your discussions with the planning officer about your s.106.

Details of what your solicitor is expected to do first are set out on the next page.

Please note that Legal Services will prepare the first draft of the s.106 using information provided to us by the planning officer dealing with the planning application. Therefore, please do not ask your solicitor to prepare a first draft.
