9. Habitat Regulations
The Council is the ‘Competent Authority’ for compliance with the Habitat Regulations in the borough and for securing nutrient mitigation, where required, to enable new development to proceed within the borough. However, it is acknowledged that nutrient mitigation created in one local authority area within the Stour catchment may be used to mitigate the effects of new development in a different local authority area within the catchment.
The Council shall co-operate and collaborate with any other Council within the Stour catchment, to facilitate each authority carrying out its enforcement functions under the 1990 Act in such a way that each Council has confidence that any Qualifying Planning Obligation can be relied upon as part of a determination to fulfil decision making obligations under the Habitats Regulations.
